About this program
A Spousal Open Work Permit (SOWP) lets the spouse or common-law partner of certain foreign workers or international students work for almost any employer in Canada.
IRCC significantly tightened SOWP eligibility for applications submitted on or after January 21, 2025. Eligibility now depends on the principal person's occupation skill level or study program, so it is important to check whether you qualify before applying.

Eligibility changed materially in 2025. Key points to be aware of:
The principal worker generally must hold a TEER 0 or TEER 1 occupation, or a select TEER 2/3 occupation in priority sectors (natural & applied sciences, healthcare, trades & transport, natural resources & agriculture).
Several TEER 2/3 fields — including business/finance/admin, sales & service, and manufacturing — are no longer eligible under the standard stream.
The worker's permit generally must have at least 16 months of validity remaining when the spouse applies.
For spouses of international students, only certain programs qualify — e.g. a master's (16+ months), doctoral, or selected professional programs (such as law, medicine, engineering or nursing).
Dependent children are no longer eligible for family open work permits. Exceptions apply for spouses of workers under free-trade agreements (e.g. CUSMA) and certain PR-transition and significant-investment cases.
SOWP rules are set by IRCC and continue to evolve. Eligibility is based on actual job duties, not job title. Always confirm current criteria on canada.ca.

Your spouse/common-law partner (the principal) holds an eligible work permit (TEER 0/1 or select TEER 2/3) or is in an eligible study program
The principal's work permit generally has 16+ months remaining (worker stream)
You are legally married or in a common-law relationship (12+ continuous months)
You live in, or will live in, Canada with the principal and hold valid temporary status (or are eligible to restore/apply)
You are admissible (medical, security and criminal background)
